It depends on the complexity of the case. Generally, it can take 1-2 weeks for a hearing to be scheduled after the eviction complaint is filed.
It depends. You may be entitled to all or part of the fee based on how much work has been done on your case. Generally, flat fees are non-refundable.

Once the complaint is filed:
  • The court provides us with an initial hearing date to present your case.
  • We serve the eviction complaint and summons on your tenant.
  • We prepare for and represent you at the initial hearing.
The majority of eviction cases are resolved at the initial hearing and are not scheduled for a full trial. Most cases are set for trial if there is a disagreement about what actually happened (known as a “factual dispute”) at the initial hearing. Examples of disputes of fact are:
  • Whether rent was actually paid.
  • Whether the tenant attempted to pay rent, but you did not accept it.
  • How much rent is owed.
  • Whether the landlord accepted partial payment.
  • Whether there is a dispute over title.
We request that the property owner or property manager attend all hearings virtually in case your testimony is required to proceed with the eviction. If there is a trial, anyone who can testify about the facts in dispute would also need to attend as a witness. Some trials are virtual, and other trials are held in person.
If your tenant fails to vacate the premises after the judgment is entered, then typically, in five days, the court will issue a writ of restitution, which you (Landlord) will have to obtain from the court and deliver to a constable/sheriff. You must also schedule a date to meet the constable/sheriff to serve the writ of restitution and remove the tenant.
